By accessing or using TheLearningApp ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Description of Service

TheLearningApp is a spaced repetition learning platform designed to help users master certifications (CompTIA Security+, CEH, CISSP, etc.) and other educational content through scientifically-proven study techniques.

User Accounts

Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to use this Service
• One person may not maintain multiple accounts

Account Security

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

Subscription Plans and Payments

Free Preview Tier

The free tier grants access to 5 flashcards per course. This is provided "as-is" and may be modified or discontinued at any time.

Paid Subscriptions

• Quick Learn ($30): One-time payment, lifetime access to specific course
• Certify Pro ($125): One-time payment, lifetime access to certification courses
• All-Access Pro ($200/month): Monthly subscription, cancel anytime
• Lifetime Mastery ($2,000): One-time payment, lifetime access to all content

Billing

All payments are processed securely through Stripe. By purchasing a subscription, you authorize us to charge your payment method.

• Monthly subscriptions auto-renew until canceled
• One-time purchases are non-refundable after 14 days
• We reserve the right to change pricing with 30 days notice

Refund Policy

Refunds are available within 14 days of purchase for one-time purchases. Monthly subscriptions are refundable on a pro-rata basis if canceled within 7 days. Contact us at learningtutorsai@gmail.com to request a refund.

Acceptable Use

You agree NOT to:

• Share your account credentials with others
• Scrape, copy, or redistribute our content without permission
• Reverse engineer or attempt to extract source code
• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service or servers
• Upload malicious code, viruses, or harmful content
• Impersonate another person or entity
• Harass, abuse, or harm other users

Intellectual Property

Our Content

All content on TheLearningApp (flashcards, courses, study materials, text, graphics, logos) is owned by us or licensed to us. You may not copy, reproduce, distribute, or create derivative works without written permission.

Your Content

If you upload custom study materials, you retain ownership. By uploading, you grant us a license to store, display, and process your content to provide the Service.

No Guarantees

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.We do not guarantee that:

• The Service will be uninterrupted or error-free
• You will pass any certification exam
• The content is 100% accurate or up-to-date
• Our spaced repetition algorithm will work for everyone

Educational Tool Only

TheLearningApp is a study aid. It does not replace official certification training, textbooks, or exam prep courses. Always verify information from official sources.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability to you for all claims shall not exceed the amount you paid us in the 12 months preceding the claim (or $100, whichever is greater).

Termination

We reserve the right to:

• Suspend or terminate your account for violating these Terms
• Remove content that violates our policies
• Discontinue the Service or any part of it at any time

You may cancel your account at any time by contacting us or using the account settings page (once implemented).

Modifications to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice on our platform. Continued use of the Service after changes constitutes acceptance of the new Terms.
